This Guthrie’s Chicken Fingers® Privacy Policy explains how Guthrie’s Franchising, Inc. d/b/a Guthrie’s Chicken Fingers®, its affiliates, subsidiaries and related entities (collectively, “Guthrie’s”, “we”, “us”, or “our”) treat information you provide to us or we collect in the course of providing our services (“Services”) which includes when you visit our website (“Website”), download or use our mobile application (“App”), or otherwise intact with us directly or indirectly.

Your use of the Website or App constitute your acknowledgement and acceptance of this Privacy Policy.

 

CHANGES TO THIS POLICY

If we change our Privacy Policy, we will post the modified privacy policy on this page and revise the “Last Updated” date above. 

 

INFORMATION WE COLLECT 

We gather personal information about our Guthrie’s Rewards (“Program”) members (“Members”) and other customers, including name, email address, phone number, billing or postal address, and login credentials as well as specific information associated with how our Members use the Program features and functionality, and other information customers provide to us directly or in connection with your use of the Services, such as details of your transactions and fulfillment of your orders, correspondence, emails and texts. We may also collect personal information related to Website and App use as described in the next section. 

 

By submitting or otherwise providing us with any personal information about another individual, you represent that you have the authority to disclose that information to us and permit our processing of that information as described in this privacy policy.

 

AUTOMATIC COLLECTION INCLUDING COOKIES & TRACKING TECHNOLOGIES

When you visit the Website or use the App, we may also use technologies to automatically collect information about your visit to our Services and may collect information such as your IP address, device ID, advertising ID, browser information, geolocation, and referring URL.  We also create log files or other functionality to help us recognize you, confirm your registration, track your activities and preferences, and maintain and improve the Services. 

 

We use first-party and third-party cookies and pixels. We may use different types of cookies and tracking technologies including (i) strictly necessary cookies (required for basic site functionality); (ii) functional cookies (remember user preferences and settings); (iii) performance cookies (collect usage data to improve the Services); and (iv) targeting cookies (track browsing activity to deliver relevant ads).

 

We partner with third party analytics and advertising providers that may use the information they collect to provide us services and for their own purposes. For example, we may use Google Analytics, among other third parties, to collect information such as the number of visitors to a site, the webpage that referred visitors to a site, and the pages visitors view within a site. You can opt-out of Google Analytics by downloading Google’s Opt-Out Browser Add-on.

 

Some internet browsers have “Do Not Track” or “DNT” features which, when turned on, send a signal to the website that the individual visiting the website does not wish to be tracked. Our Website does not honor DNT signals. However, you can turn off non-essential cookies through your browser settings, but if you turn cookies off, you won’t have access to certain features and some of our Services may not function properly.

 

INFORMATION USE

We use your personal information to operate our business, personalize your experience, analyze type and frequency of use and trends, respond to inquiries from you, notify you about new features and special promotions, support your use of the Services, and improve the Services. We may also use your personal information as necessary to comply with law or legal process, protect our rights or the rights of others, or as otherwise disclosed to you at the point of collection or with your consent. 

 

We may also combine or aggregate personal information or anonymize it in such a way that you may not reasonably be re-identified and may use such anonymized information for any purpose permitted by law. In such case, we commit not to attempt to reidentify the information.

Guthrie’s does not sell personal information. We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates, except that text messaging originator opt-in data and consent will not be shared with our subsidiaries or affiliates
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations
  • To third parties to market our products or services to you on our behalf, subject to your applicable privacy choices and preferences
  • For any other purpose disclosed by us when you provide the information or with your consent

 

Additionally, if we are involved in a merger, acquisition, or other corporate transaction, we may share your personal information during the diligence process with counterparties and others assisting with the transaction, as well as with a successor as part of such a transaction. We may also share your personal information pursuant to a financing arrangement or event of bankruptcy.

 

We may also share personal information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to cooperate with law enforcement, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users or the public, or (v) protect against legal liability.

 

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text message services.

 

We may also report general demographic information about our customers and Members to third parties. The general demographic information will not, however, specifically identify you, but will instead be anonymized and aggregated information.

 

MEMBER PREFERENCES

For Members, to update certain personal information we have about you, or if you wish to change certain preferences (including certain communication preferences), (1) log into your registered App account and change your account settings (including location tracking), (2) change your device’s settings for our App, or (3) contact us as described at the end of this Privacy Policy. If you no longer want us to collect information through the App, please uninstall it or delete your account within the application.

 

COMMUNICATION PREFERENCES

For all customers, you may opt-out of receiving promotional or marketing emails from us at any time by using the “unsubscribe” link in the email you receive or otherwise contacting us using the contact information listed below. You may opt-out of receiving text messages from us at any time by replying “STOP” or otherwise communicating your request to opt-out as further described in our Text Messaging Terms & Conditions. Please note we may continue to send you other non-marketing emails related to your relationship with us.

 

SECURITY

We follow generally accepted industry security standards to safeguard and help prevent unauthorized access, maintain data security and correctly use personal information.

However, no commercial method of information transfer over the Internet or electronic data storage is 100% secure, and we cannot guarantee the absolute security of that information during its transmission or its storage in our systems. Any user identification names or passwords necessary to access the Services shall be maintained by you as confidential and should not be shared with anyone not authorized to have access to your personally identifiable information.

 

THIRD-PARTY LINKS AND THIRD PARTY SOFTWARE

This Privacy Policy applies solely to information collected by our us. Any third-party links and applications in or on our Services (including, without limitation, any retailer links and applications) are subject to such third party’s separate and independent privacy policies and terms of use, and we have no responsibility or liability for the content and activities of such linked sites or applications. Notwithstanding the above, we welcome any feedback about these linked sites and applications. We recommend that you review all applicable third party privacy policies before you disclose personal information.

 

PRIVACY RIGHTS BASED ON RESIDENCY

Depending on your jurisdiction of residence, you may have rights regarding your personal information such as the right to access, correct, delete, opt-out of sale or sharing or targeted advertising, or appeal. To exercise any of these rights or to obtain further information regarding your rights, please contact us using the information below. Please note that we reserve the right to decline your request as permitted by law. Only you, or as permitted by law, a person that you authorize to act on your behalf, may make a request related to your personal information. For certain requests, we must verify your request before we can fulfill it. Verifying your request will require you to provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or that the requestor is authorized to act on your behalf. We will not discriminate against you for exercising your privacy rights.

 

CHILDREN’S PRIVACY

We do not knowingly collect personally identifiable information from children under the age of thirteen (13). The Website and App are not directed at children under the age of thirteen (13), and registering as a Member, you represent that you are not under the age of thirteen (13). Parents or legal guardians may not agree to the Terms of Use, this Privacy Policy, or the disclosure of a child’s personally identifiable information on such child’s behalf.

 

CONSENT TO PROCESSING OF INFORMATION IN THE UNITED STATES

Notwithstanding your country of origin, or country, state and/or province of residence, by utilizing the Services and/or directly providing personal information to us, you hereby agree to and acknowledge your understanding of the terms of this Privacy Policy, and consent to have your personal data transferred to and processed in the United States and/or in other jurisdictions as we determine.
